What is the SYAC?

SuperYacht Access Club (SYAC) is a different tack on the SuperYacht chartering industry. Make an upfront payment, plus a small monthly subscription, and you’ll receive a Membership credit package which can last up to 25yrs. The frequency you use your credits is up to you. You can choose different experiences, different days or different seasons. Use your credits to bring a partner, friend or business associate. It’s the ultimate flex.

What is the aim of SuperYacht Access Club (SYAC)?

SYAC can be some or all of these for you: a lifestyle upgrade, a professionally based networking group, a gamified social club with rankings and prizes, and/or a business community. We are dedicated to your enjoyment and believe this is the ultimate environment to harness the potential of our members.

How Does it Work?

Our How It Works page outlines the basics, but as a SYAC member, you can experience years of superyacht luxury. Starting with our first home port of Sydney, we will be expanding the fleet over time, so you can enjoy experiences on multiple SuperYachts around the world.

Each membership level offers a competitive credit package which will allow you a yearly superyacht experience over 25 consecutive years, or you can use credits more frequently until they run out. If you wish to upgrade to a higher experience, you can do so, at the cost of additional credits.

You are not restricted to any specific experience, season, or day of the week. However, choosing an experience at a different home port or in high season may incur additional credits. The chartering year is defined as Winter to Winter with Spring (shoulder), Summer (high), and Autumn (shoulder) seasons respectively.

What are the Experiences and their costs?

The purchase of an SYAC membership provides you with your choice of experience, offering incredible value to our members, with a joining fee of between $6,995 and $38,995 (US$), depending on which membership level you choose, plus a small monthly subscription to keep your membership active.

This represents an amazing ground floor entry into the luxurious SuperYacht experience and access to a fun and professional community. Limited exclusively to only 5,555 members in each home port.

What are Yacht Games, and how do they work?

Our innovative Yacht Games provide an exciting and motivating way to benefit more from SYAC, by climbing up the ranks in our community. As you compete in mind, body and spirit competitions, you’ll qualify for higher ranks, and can benefit through prizes and more access to experiences within the SYAC community.

What is included with your membership?

For the purchase of your membership plus a small monthly subscription, you'll receive a credits package for access to a luxury superyacht. Your experience will include cruising on the superyacht, catering of any meals, use of yacht toys, participation in Yacht Games with prizes, and may additionally include expert speakers or bonus onboard benefits such as DJ's, themed party, and/or performers, depending on your booking dates.

Do you already have the yacht so that I can view it?
SYAC is currently in the pre-launch stage, and is currently offering a 25% discount on memberships in the first Sydney community. Credit packages purchased go towards the superyacht purchases as well as supporting up to 25 years of operational costs, staffing, maintenance, etc. All credit packages are also fully refundable in the event that the minimum membership number of 1,000 is not reached by the summer 2026 launch.

How does SYAC compare to other Yacht Chartering sharing services?
There is no comparison between other yacht chartering services that cater to people who can afford $3,500 per hour rates for a one-time event, and our packages offering several dozen experiences for one upfront fee, with each experience lasting between 7 and 24 hours.

Our membership includes: a lifestyle experience, a professionally based networking group, a gamified social club with rankings and prizes, and a business community.

Please view our Membership page for more details, where you'll find the entry level is significantly lower (as little as 10% of the cost of other chartering services) with no additional costs for fuel, food, staff, etc, that other chartering companies add onto their high hourly rates.

Do I actually own the SuperYacht?
No, there are no ownership rights that come with Membership. Your membership only provides access to superyacht events, but there is no legal ownership of the superyacht suggested or implied. You will receive a credit package you can use at your discretion to access the superyacht, with all access benefits attached to it, and you can purchase more credit packages.

As the owner of the superyachts, SYAC maintains ongoing management of the superyachts to ensure you have an amazing experience every time (your credits covering fuel, food, entertainment, insurance, staffing, berthing, maintenance, etc), and can enjoy a walk-on and walk-off luxury experience.

Who are the Elite 250?
The "Elite 250" consist of any SYAC member who are in the FIRST 250 people to join up in the Home Port where your superyacht is berthed. It rewards those proactive members who are quick to take advantage of our packaged offers. Extra benefits are provided to them including: bonus superyacht events, discounts, priority booking, and other bonus surprises.

Why is the joining fee and membership subscription in USD?
SYAC is building an international community with exciting benefits for our members, and we are purchasing superyachts in EURO or USD. SYAC must ensure that funds from memberships can meet the costs of these superyachts by charging in the same currencies. This ultimately means superior quality superyachts for our members.

I have a big social media following, can I benefit from your referral/affiliate program?
Absolutely! We welcome affiliates and Influencers to promote us and you will receive a significant payment based on the credits package. For example, referring 10 people may pay you up to $25,000 plus bonus superyacht credits. Please use our Contact Us form to enquire.

So What's the Difference between a Yacht, SuperYacht and MegaYacht?

A Yacht is generally defined as under 24 metres (79ft).
A SuperYacht is over 24 metres (79ft) but less than 60 metres (197 ft).
A MegaYacht starts at over 60 metres (197 ft).

The SuperYatcht proposed for SYOC will be between 30-40 metres (98-131 ft) and will cater for 60+ people per day.

How many SuperYachts will be available, and from which ports?

Each SuperYacht has a home berth (see Location map) and future home berth options are partly based on membership demand for memberships in each location. The first SuperYachts will be based on the East Coast of Australia, servicing Sydney NSW and the Gold Coast QLD.

Can I use my credits on any SuperYacht in the SYAC fleet?

Your membership and credits are linked to your home port, however you can pay additional credits to access experiences on another yacht in another location.

Can I change my experience once I purchase it?

You cannot change the membership level you purchased if you’ve already used some of the credits. Each experience has its own price point, and you can upgrade to higher experience by using additional credits.

What forms of payment do you accept?

We accept Credit Cards (Visa/Mastercard), along with PayPal, Direct Deposit, and instalment options.

By embarking on this adventure and accessing or using the SYAC platform, you agree to be bound by these Terms.
‍Acceptance of Terms
‍1.1. Welcome aboard! By accessing or using the SYAC website and services, you agree to sail along and abide by these Terms. If you don't fancy these Terms, kindly disembark and refrain from accessing or using the SYAC platform or buying our NFT's.

‍Eligibility
‍2.1. To come aboard and enjoy the SYAC platform, you must be at least 18 years old. We wouldn't want any little pirates running amok!
2.2. By using the SYAC platform, you certify that you meet the eligibility requirements and possess the legal capacity to embark on this splendid voyage.

‍Intellectual Property
‍3.1. Ahoy, matey! All the marvelous intellectual property rights tied to the SYAC platform, including captivating trademarks, logos, designs, and copyrights, are owned or licensed by SYAC.
3.2. While sailing with us, please be mindful that you shall not use, reproduce, distribute, or modify any of the SYAC platform's remarkable content without the prior written permission of SYAC.

‍Membership and User Accounts
‍4.1. Arr, to access certain delightful features of the SYAC platform, you may be required to create a user account. Fear not, for the process shall be as smooth as a calm sea.
4.2. By creating your user account, you agree to provide us with accurate, complete, and up-to-date information. And just between us, we'll keep those account credentials as safe as hidden treasure.
4.3. Remember, you're the captain of your ship! You shall be solely responsible for all activities that occur under your user account, and should you detect any unauthorized use or a breach of security, notify SYAC immediately.

‍NFTs and Ownership
‍5.1. Ahoy, NFT enthusiasts! SYAC may offer you the opportunity to discover and acquire NFTs on our platform, each one representing a unique digital asset related to super yachts and the enchanting yachting industry.
5.2. By becoming the proud owner of an NFT acquired from SYAC, you shall receive a limited, non-exclusive, and non-transferable right to access and display the associated digital treasure.
5.3. While you hold the keys to the digital realm, please be aware that SYAC retains all ownership rights, including the precious intellectual property rights, to the NFTs and their mesmerizing underlying digital assets.

‍Website and Wallet interaction
‍6.1 Be aware! the SuperYacht Access Club (SYAC) website is just an interface allowing participants to exchange digital collectables. This website and its connected services are provided “as is” and “as available” without warranty of any kind. By using the SuperYacht Access Club (SYAC) website, you are accepting sole responsibility for any and all transactions involving SuperYacht Access Club (SYAC) digital collectables.
6.2 Users are entirely responsible for the safety and management of their own private digital wallets and validating all transactions and contracts generated by this website before approval.
6.3 Furthermore, as the SuperYacht Access Club (SYAC) smart contract runs on the Ethereum network, there is no ability to undo, reverse, or restore any transactions.

‍Usage Restrictions
‍7.1. Avast, me hearties! As you sail through the SYAC platform, we kindly request that you refrain from engaging in any illegal, fraudulent, or unauthorized activities. We prefer smooth waters, not troubled tides.
7.2. We beseech you not to attempt to gain unauthorized access to the SYAC platform or its systems. It's best to enjoy the voyage and avoid disrupting our splendid services.
7.3. Furthermore, we kindly ask that you refrain from any activity that may cause damage to the SYAC platform, impact our reputation, impact functions of our services, or impair the delightful experiences of fellow sailors.

‍Prohibited Content
‍8.1. Aye, we value a respectful and harmonious journey. Therefore, you shall not upload, post, transmit, or share any content that may cause harm, be it through obscenity, defamation, infringement, or any other means that would violate the rights of others.
8.2. As guardians of this vessel, SYAC reserves the right to remove or block any content that breaches these Terms and disturbs the tranquillity of our voyage. No need to rock the boat!

‍Termination
‍9.1. Shiver me timbers! SYAC may, at its sole discretion, suspend or terminate your access to the SYAC platform should you violate these Terms or engage in conduct that may jeopardize the safety of SYAC or our fellow sailors. This may also restrict your use of any NFT and any services and experiences relates to it.
9.2. In the unfortunate event of termination, your rights to access and use the SYAC platform shall cease immediately. Fair warnings to you.

‍Limitation of Liability
‍10.1. While we strive to chart a reliable course, SYAC cannot guarantee the accuracy, completeness, or reliability of all content or information provided on the SYAC platform. When there are storm clouds on the horizon, always proceed with caution.
10.2. Should you encounter any direct, indirect, incidental, consequential, or punitive damages arising from your use of the SYAC platform, including loss of data, loss of NFT, profits, or business opportunities, we regret to inform you that SYAC shall not be held responsible. The seas can be treacherous, after all.
10.3. Please note that some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such cases, our liability shall be limited to the extent permitted by applicable law.

‍Indemnification
‍11.1. As you set sail with SYAC, you agree to indemnify and hold SYAC, its affiliates, officers, directors, employees, and agents harmless from any claims, damages, liabilities, and expenses (including legal fees) arising from your use of the SYAC platform, your violation of these Terms, or any infringement of the rights of third parties. We sail together, through smooth and rough waters alike.

‍Modifications to the Terms
‍12.1. Like the ever-changing sea, SYAC reserves the right to modify or update these Terms at any time. We'll hoist the signal flags to notify you of any changes.
12.2. Any alterations to the Terms shall take effect immediately upon their posting on the SYAC website.
12.3. Fear not, though! Your continued use of the SYAC platform after any modifications to the Terms signifies your acceptance of the updated voyage plan.

‍Governing Law and Dispute Resolution
‍13.1. These Terms shall be governed by and interpreted in accordance with the laws of NSW, Australia. Let's navigate by familiar stars.
13.2. Should any disputes arise on our voyage, we kindly request that we embark on a good-natured negotiation to resolve them amicably.
13.3. If, despite our best efforts, we cannot find common ground, we agree to submit to the exclusive jurisdiction of the courts of NSW, Australia to settle any legal proceedings. Let the compass guide us.

‍Severability
‍14.1. Should any provision of these Terms be found invalid, illegal, or unenforceable, the remaining provisions shall continue to guide our journey with unwavering strength.

‍Entire Agreement
‍15.1. These Terms constitute the entirety of our agreement, the very compass that guides us through the SYAC voyage. Any prior agreements or understandings shall be consigned to the depths. By setting sail and engaging with the SYAC platform, you acknowledge that you have read, understood, and wholeheartedly agreed to these Terms of Use and/or Terms and Conditions. Chartering

(information for the general public and non-NFT holders)

Welcome to SYAC Charters!

Please carefully read the following terms and conditions, as they outline the rights and obligations between you (the "Charterer") and SYAC Charters (referred to as "we," "us," or "the Company") regarding the chartering of a superyacht. These terms and conditions govern the agreement between the Charterer and SYAC Charters for the duration of the yacht charter.
Charter Agreement
‍1.1 The Charterer acknowledges and agrees that the charter agreement is binding once both parties have signed the charter contract and the initial deposit has been received by the Company.

‍Charter Period
‍2.1 The charter period shall commence and terminate as specified in the charter agreement. The Charterer must strictly adhere to the agreed-upon schedule.

‍Charter Fee and Payment Terms
‍3.1 The Charterer shall pay the charter fee, as specified in the charter agreement, in the following installments: 50% upon signing the agreement, and the remaining 50% 30 days before the charter period begins.
If the booking is made within 30 days of the charter, then full payment is required upon signing.
3.2 The Company reserves the right to cancel the charter if payment is not received within the specified timeframe.

‍Costs Included
‍4.1 The charter fee includes the hire and operational costs of the yacht during the charter period, including:Crew wages and their meals. Yacht insurance. Use of onboard equipment and amenities.

‍Costs Excluded
‍5.1 The Charterer shall be responsible for the payment of additional costs, including but not limited to:
- Fuel for all cruising and fuel for recreational water toys.
- Provisioning, meals, and beverages.
- Berthing and customs fees.
- Communication costs.
- Crew gratuities, which are customary and usually 10-20% of the charter fee.

‍Obligations of the Charterer
‍6.1 The Charterer shall:
Provide accurate information regarding the number of guests and their dietary requirements prior to the charter.
Comply with all laws, regulations, and customs of the charter destination(s).
Treat the yacht and its equipment with care and respect.
Follow the captain's instructions and adhere to safety guidelines.

‍Liability
‍7.1 The Charterer acknowledges that yacht chartering involves inherent risks and agrees to release the Company from any liability for personal injury, loss, or damage to property arising from the charter.
7.2 The Charterer shall be responsible for any damages caused to the yacht or its equipment due to willful misconduct or negligence.

‍Cancellation and Refund Policy
‍8.1 In the event of a cancellation by the Charterer:
Cancellations made within 14 days prior to the charter period will result in the forfeiture of the deposit.
Cancellations made within 7 days prior to the charter period will result in the forfeiture of the full charter fee.
The Company may consider rescheduling the charter based on availability and the specific circumstances.

‍Weather Conditions
9.1 The Captain is responsible for determining the yacht's itinerary based on weather conditions and ensuring the safety of all guests. The Charterer shall comply with the Captain's decisions regarding route changes or alterations due to weather conditions.

‍Governing Law and Jurisdiction
10.1 These terms and conditions shall be governed by and construed in accordance with the laws of NSW, Australia. Any disputes arising from the charter agreement shall be subject to the exclusive jurisdiction of the courts of NSW, Australia.

‍Entire Agreement
11.1 These terms and conditions, along with the signed charter agreement, constitute the entire agreement between the Charterer and SYAC Charters, superseding any prior agreements, understandings, or representations.
11.2 Any modifications or amendments to these terms and conditions must be made in writing and agreed upon by both parties.
11.3 If any provision of these terms and conditions is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
11.4 No waiver of any breach of these terms and conditions shall be construed as a waiver of any subsequent breach.
11.5 The headings in these terms and conditions are for convenience only and shall not affect their interpretation.

‍Limitation of Liability
12.1 It is a condition of the trade terms and conditions agreement that the liability of SYAC Charters, its servants, agents, and subcontractors is agreed to be limited in accordance with the Limitation of Liabilities and Maritime Claims Act 1989.

‍Indemnification
13.1 The Charterer agrees to indemnify and hold harmless SYAC Charters, its agents, and employees, from and against any and all losses, claims, actions, costs, expenses, fees, damages, fines, and liabilities (including reasonable legal fees) caused by any negligent act or omission by SYAC Charters or members of the Charterer's group.

‍Exclusion of Liability
14.1 SYAC Charters is not liable for any death, loss, damage, or injury to any person or property which occurs and is attributable to or associated with:
- Failure to follow any reasonable direction given by the master or crew.
- Failure to comply with any of these terms or conditions.
- Failure to comply with any warning sign. Unreasonable or unsafe behavior.
- Willful misuse of the equipment or facilities of the vessel.
- Intoxication or the use of prohibited drugs.

By signing the charter agreement and submitting the initial deposit, the Charterer acknowledges that they have read, understood, and agreed to abide by these terms and conditions set forth by SYAC Charters.

Yacht Games

General Terms and Conditions
‍1.1. SYAC Yacht Games (hereinafter referred to as "SYAC") is an event business that organizes various games and activities (hereinafter referred to as the "Events") held at the Games Venue.
1.2. By participating in any Event organized by SYAC, all participants (hereinafter referred to as "Entrants") agree to abide by these Terms and Conditions.
1.3. SYAC reserves the right to modify or amend these Terms and Conditions at any time, and it is the responsibility of the Entrants to review and understand the most up-to-date version.

‍Events
‍2.1. The Events organized by SYAC are categorized into three distinct areas: mind, body and spirit. Each Event will be specifically designed to challenge and engage participants in the respective areas.
2.2. SYAC reserves the right to determine the specific nature and requirements of each Event, including but not limited to the rules, courses, challenges, and objectives.

‍Prizes
‍3.1. Entrants participating in SYAC Events may have the opportunity to win prizes, which may include but are not limited to cash, physical gifts, additional yacht passes, exclusive events, and/or Yacht coins.
3.2. The allocation and distribution of prizes shall be at the sole discretion of SYAC, and no guarantee of winning or receiving any prize is implied or stated.

‍Indemnity and Limited Liability
‍4.1. Entrants acknowledge and agree that participation in the Events involves inherent risks, including but not limited to physical exertion, physical contact, water-related activities, and potential injury.
4.2. By participating in any Event, Entrants hereby release, discharge, and agree to indemnify and hold SYAC, its directors, employees, agents, and affiliates harmless from any and all claims, demands, actions, liabilities, expenses, or damages arising from or related to participation in the Events, including but not limited to injuries, death, distress, or loss of personal property.
4.3. SYAC's liability, whether in contract, tort, or otherwise, for any claim, loss, damage, or expense arising out of or in connection with the Events shall be limited to the maximum extent permitted by law.

‍Force Majeure
‍5.1. SYAC shall not be held liable or responsible for any failure to perform, delay, or interruption of the Events due to any force majeure event, including but not limited to acts of God, natural disasters, strikes, lockouts, riots, acts of war, or any other unforeseen circumstance beyond SYAC's reasonable control.

‍Insurance
‍6.1. SYAC shall maintain appropriate insurance coverage for the Events, as deemed necessary by SYAC in its sole discretion. However, it is the responsibility of the Entrants to maintain their own personal insurance coverage to protect against any potential risks associated with participation in the Events.

‍Conditions of Entry
‍7.1. Entrants must comply with all rules, regulations, and instructions provided by SYAC and its staff before, during, and after the Events.
7.2. SYAC reserves the right to disqualify any Entrant who fails to comply with the rules, engages in unsportsmanlike conduct, or behaves in a manner deemed inappropriate by SYAC, without any liability or obligation to provide a refund or compensation.
7.3. Entrants must be of legal age to participate in the Events.
7.4. SYAC reserves the right to refuse entry to any individual for any reason, including but not limited to concerns regarding the safety and well-being of participants or the integrity of the Events.

‍No Expectations of Winning
‍8.1. Entrants acknowledge and agree that participation in the Events does not guarantee the winning of any money or prizes.
8.2. SYAC makes no representations or warranties regarding the likelihood of winning any money or prizes, and shall not be held responsible for any disappointment or dissatisfaction resulting from not winning.

‍Governing Law and Jurisdiction
‍9.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction where SYAC is registered.
9.2. Any dispute, controversy, or claim arising out of or relating to these Terms and Conditions, including the validity, interpretation, performance, or breach thereof, shall be settled by binding arbitration in accordance with the rules of the relevant arbitration association.

‍Severability
‍10.1. If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
10.2. In such cases, the invalid or unenforceable provision shall be replaced by a valid and enforceable provision that achieves the intended purpose to the maximum extent possible.

‍Entire Agreement
‍11.1. These Terms and Conditions constitute the entire agreement between SYAC and the Entrants regarding the Events, and supersede any prior agreements or understandings, whether written or oral.
11.2. No modification or amendment of these Terms and Conditions shall be binding unless in writing and signed by both parties.

By participating in any SYAC Yacht Games Event, Entrants acknowledge that they have read, understood, and agreed to be bound by these Terms and Conditions.
